These terms and conditions ("Terms") outline the rules for using our website (phteah24.com), mobile apps, and services (collectively, the "Services"). By accessing or using the Services, you agree to these Terms, our Privacy Policy, and any additional guidelines. If you do not agree, do not use the Services.

Disclaimer on Platform Role and Licensing

phteah24.com is not a real estate agent, broker, rental agent, or property management company. We do not provide brokerage services, negotiate on behalf of users, manage properties, collect rents, or act as an intermediary in transactions. Our Services solely enable direct connections between landlords and tenants via listings and matching tools, without involvement in any rental agreements or disputes. As such, we do not require a real estate agent license under Cambodian law, including Prakas No. 064 on Real Estate Business Services Licensing. Users are responsible for their own compliance with applicable regulations.

1. Acceptance of Terms

  • Your use constitutes acceptance. We may update Terms by posting changes; continued use implies agreement.
  • You must be 18+ years old or have legal capacity to agree.
  • Information on the site is general and not professional advice—seek legal/financial counsel for rentals.

2. User Accounts and Responsibilities

  • Register with accurate information; keep login details secure.
  • Listings must comply with Cambodian laws (e.g., no illegal properties).
  • Tenants: Use for personal searches; no commercial exploitation.
  • All users: Do not post misleading, offensive, or infringing content; respect intellectual property.

3. Listings and Transactions

  • Landlords grant us a non-exclusive license to use listings (text, images) for promotion.
  • We may remove listings if violating Terms, laws, or deemed inappropriate (e.g., inaccurate, discriminatory).
  • Direct matching: We facilitate contact but are not party to rental agreements—users handle negotiations, contracts, and disputes independently.
  • Pro-Tenant Tools: Standard contracts are templates; customize and seek legal review.

Property Ownership Requirement

phteah24.com is a platform exclusively for property owners and their authorized representatives. By listing a property, you confirm that:

  • You are the legal owner of the property, OR
  • You have explicit written authorization from the property owner to list their property on their behalf

Real estate agents, brokers, and third parties are strictly prohibited from listing properties they do not own or are not explicitly authorized to represent. This includes, but is not limited to:

  • Copying listings from other platforms without owner consent
  • Listing properties based solely on publicly available information
  • Acting as an intermediary without the owner's written permission

Violations will result in immediate removal of the listing without refund of any fees paid. Repeat offenders will be permanently banned from the platform. We reserve the right to take legal action against fraudulent listings.

4. Payments and Fees

  • No commissions on rentals; all transactions are direct.
  • Taxes: Users handle applicable taxes (e.g., 10% VAT on rentals if applicable).

5. Restrictions on Use

You agree not to:

  • Use automated tools to scrape data or overload the site.
  • Transmit spam, viruses, or harmful content.
  • Build competing databases or misuse AI outputs.
  • Impersonate others or solicit unauthorized information.
  • Violate Cambodian laws, including real estate regulations.

We may suspend accounts for violations.

6. Intellectual Property

  • Site content is owned by us or licensors; limited personal use only.
  • Users retain rights to their content but grant us perpetual license for site operations.

7. Third-Party Links and Content

  • Links to external sites (e.g., payment gateways) are for convenience; access at your risk.
  • We do not endorse third-party content; no liability for losses.

8. Disclaimer and Limitation of Liability

  • Services provided "as is"; no warranty on accuracy.
  • We disclaim liability for losses from site use, listings, or transactions (e.g., disputes, property issues).
  • Liability limited to $100 or fee paid, excluding indirect damages (e.g., lost profits).
  • Non-excludable rights under Cambodian law apply.
